Love’s Dog of the Year Photo Giveaway

Official Rules 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. 
 
Sponsor: The Giveaway is sponsored by Love’s Travel Stops & Country Stores, Inc. 10601 North Pennsylvania Ave. Oklahoma City, OK 73120 (the “Sponsor” or “Love’s Travel Stops”). 
 
Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, you agree to accept the decisions of Love’s Travel Stops as final and binding as it relates to the content of this Giveaway. You acknowledge and agree that your entrance into the Giveaway constitutes your acceptance of this agreement, has the same effect as manually signing this agreement with Love’s Travel Stops and creates a valid, binding contract between You and Love’s Travel Stops. If You do not agree to the terms of this agreement, You should not enter the Giveaway. 

Time Period: The Love’s Dog of the Year Photo Giveaway (the “Giveaway”) shall begin 10:00:00 AM Central Time (“CT”) on August 11, 2021 and end 11:59:59 PM CT on August 26, 2021 (such period, the “Giveaway Period”). 

Eligibility: This Giveaway is open only to those who are 18 years of age or older as of the date of entry. The Giveaway is only open to legal residents of the fifty (50) United States (excluding, without limitation, Puerto Rico, other US territories and possessions), and is void where prohibited by law. Employees, officers, directors, agents, representatives and their immediate families (spouse, parents, children, siblings, and each of their spouses regardless where they live) or members of the same household of Sponsor, and anyone connected with the production or distribution of the survey or the Giveaway ("Giveaway Entities"), as these designations might apply, are not eligible to enter or be awarded a prize. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. You are not authorized to participate in the Giveaway if you are not located within the 50 United States. 

How to Enter: The Giveaway must be entered through Twitter, Instagram or Facebook. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Love’s Travel Stops. You may enter only once. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Love’s Travel Stops. There is one way to enter the Giveaway: 
 
Tag Love’s in your dog park photo using #LovesDogPark and follow Love’s account (1) Post your dog park photo and tag Love’s Instagram, Twitter or Facebook account (2) Use #LovesDogPark in the post (3) Follow Love’s Instagram, Twitter or Facebook account.   
 
Each submission (each an “entry” or “entries”) must be made by the Giveaway Period End Date to be eligible for the Giveaway. All other forms of attempted entry into the Giveaway are ineligible and may cause disqualification. All comments or submissions with inappropriate or abusive language will be deleted, and subject to disqualification. All entries made in violation of these rules will be disqualified. By participating in the Giveaway, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Limit: One (1) entry per person. 
 
Entry Periods: There is one (1) Entry Period/Giveaway Period as defined in the Entry Period chart below. Entries must be received during the applicable Entry Period to be eligible for that Entry Period drawing. 

Winner Selection and Notification: 1 Winner will be selected by a random drawing under the supervision of Love’s Travel Stops, on or about August 27, 2021 from among all eligible entries received within the Entry Period. Potential winners will be notified by email, Instagram, Facebook, Twitter, phone and/or mail. Love’s Travel Stops shall have no liability for Winner’s failure to receive notices due to spam, junk email or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If a Winner cannot be contacted, is ineligible, fails to claim the prize within 3 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by a Winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations. If a Winner notification is returned as undeliverable or if the selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and an alternate winner may be selected in a separate random drawing. Upon prize forfeiture, no compensation will be given. 

Prize: 1 winner will receive a customer illustration of their winning dog park photo (ARV $60), Love’s Gift Card (ARV $500), Love’s branded dog items (ARV $75). The specifics of the prize shall be solely determined by Love’s Travel Stops. No cash or other prize substitution shall be permitted except at Love’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by a Winner is permitted. Acceptance of prize constitutes permission for Love’s Travel Stops to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. The odds of winning depend on the number of eligible entries received. A prize will be awarded provided it is claimed properly according to these rules. The winner acknowledges that Sponsor and all other Giveaway Entities have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize or regarding the use, value or enjoyment of the prize. 

Publicity Release: Acceptance of the prize constitutes licenses and permission to use the winner's name, voice, photo, image, likeness and any and all identifying characteristics including, but not limited to, the taking of photographs and/or videos by the Sponsor's photographer/videographer for publicity purposes, without further consent or compensation, unless prohibited by law. Participants hereby relinquish all rights, title, and interest in any advertising or publicity material and waive all rights to payment or compensation therefore or for the use thereof, and consent to any publicity materials created by Love’s Travel Stops using participant’s name, address, or likeness associated with the Giveaway. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of the prize. 
 
Winners List: For the Name of the Prize Winners—Available after September 1, 2021; send a self-addressed, stamped #10, business envelope to: Winner— “Love’s Dog of the Year” Winners List, 10601 North Pennsylvania Ave. Oklahoma City, OK 73120. Requests must be received by September 8, 2021.

Privacy Policy: All entries submitted become the property of the Sponsor and none will be acknowledged or returned. All Entry information will be held and used in accordance with these Official Rules located at Loves.com and the Sponsor's Privacy Policy located at https://www.loves.com/en/terms-and-privacy. 

Twitter, Instagram and Facebook: This Giveaway hosted by Love’s Travel Stops is in no way sponsored, endorsed, administered by, or associated with Twitter, Instagram or Facebook. By participating in this Giveaway each participant is completely releasing Twitter, Instagram and Facebook of all liability. 
 
Disputes, Claims or Actions: Entrant agrees that any and all disputes, claims, action and causes of action arising out of or connected with this Giveaway or the prize awarded and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively in a court of competent jurisdiction sitting in Oklahoma. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway and never shall include consequential, incidental or punitive damages, and in no event attorneys' fees. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you. 

LIMITATION OF LIABILITY: BY ENTERING, YOU AGREE TO RELEASE AND HOLD HARMLESS LOVE’S AND ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS, DIRECTORS, FACEBOOK, INSTAGRAM, AND TWITTER FROM ANY LIABILITY, ILLNESS, INJURY, DEATH, LOSS, LITIGATION, CLAIM, OR DAMAGE THAT MAY OCCUR, DIRECTLY OR INDIRECTLY, WHETHER CAUSED BY NEGLIGENCE OR NOT, FROM: (I) SUCH ENTRANT’S PARTICIPATION IN THE GIVEAWAY AND/OR HIS/HER ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE OR ANY PORTION THEREOF; (II) TECHNICAL FAILURES OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE MALFUNCTION OF ANY COMPUTER, CABLE, NETWORK, HARDWARE, OR SOFTWARE, OR OTHER MECHANICAL EQUIPMENT; (III) THE UNAVAILABILITY OR INACCESSIBILITY OF ANY TRANSMISSIONS, TELEPHONE, OR INTERNET SERVICE; (IV) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE PROMOTION; (V) ELECTRONIC OR HUMAN ERROR IN THE ADMINISTRATION OF THE PROMOTION OR THE PROCESSING OF ENTRIES. IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO FACEBOOK, AND/OR YOUR ENTRY INTO THE GIVEAWAY. WITHOUT LIMITING THE FOREGOING, THIS GIVEAWAY AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. General Terms and Conditions: No entrant or winner shall have the right to contest any decision by the Sponsor concerning any aspect of the Giveaway or the interpretation of the Official Rules or the determination as to the qualification of entries. The Sponsor is not responsible for those who are not solicited to enter or comment on the post. The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Giveaway should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway or if, in the Sponsor’s sole determination, it believes that the integrity of the Giveaway has been, or could be, compromised or that the Giveaway is not capable of running as planned or fairly. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. The Sponsor reserves the right to disqualify any entry from the Giveaway if, in the Sponsor’s sole judgment, an entrant has not complied with these Official Rules, or any entrant it finds, in its sole discretion, to be tampering with the entry process or the operation of the Giveaway or the Post. Without limitation, an entrant’s entries will be disqualified, at the sole discretion of Sponsor, if entrant attempts (i) to enter the Giveaway through any means other than as described in these Official Rules; or (ii) provides information that is inaccurate or fraudulent; or (iii) attempts to disrupt the Giveaway or circumvent the terms and conditions of these Official Rules. 

Other Terms and Conditions: The Giveaway is void where prohibited, licensed, restricted or taxed. All federal, state, and local laws and regulations apply. If any provision of the Giveaway shall be deemed to violate any federal, state, or local law, regulation or ordinance, it shall be amended to conform to such law and all other provisions shall remain in full force and effect. If Sponsor is required by applicable federal, state, or local law, regulation or ordinance, or by action of an administrative agency to cease offering the Giveaway in any jurisdiction, Sponsor reserves the right to (i) terminate the Giveaway in such jurisdiction in its entirety, and/or (ii) cancel and remove from participation in the Giveaway any and/or your entry if you reside in such jurisdiction, without penalty and without obligation to you.
