Love's Rewards Program Membership Agreement

IN CONSIDERATION OF LOVE’S TRAVEL STOPS & COUNTRY STORES, INC. (TOGETHER WITH ITS AFFILIATES, “LOVE’S”) ALLOWING YOU TO PARTICIPATE IN THE LOVE'S REWARDS STORE DISCOUNT PROGRAM (“PROGRAM”) AND USE THE SERVICES PROVIDED BY AND RELATED TO THE PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS PROGRAM MEMBERSHIP AGREEMENT (THE “AGREEMENT”).

YOUR PARTICIPATION IN THE PROGRAM CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT. BY PARTICIPATING IN THE PROGRAM, YOU CONSENT TO RECEIVE THIS AGREEMENT AND ALL RELATED DISCLOSURES, NOTICES, AND COMMUNICATIONS IN ELECTRONIC FORM, AND YOU AGREE THAT SUCH ELECTRONIC DELIVERY SATISFIES ANY LEGAL REQUIREMENT THAT SUCH COMMUNICATIONS BE IN WRITING. YOU HAVE THE RIGHT TO RECEIVE A PAPER COPY OF THIS AGREEMENT BY CONTACTING LOVE’S CUSTOMER SERVICE AT [CONTACT INFO]. YOU MAY WITHDRAW YOUR CONSENT TO RECEIVE ELECTRONIC COMMUNICATIONS AT ANY TIME, BUT WITHDRAWAL OF CONSENT MAY RESULT IN TERMINATION OF YOUR PROGRAM MEMBERSHIP. YOU ACKNOWLEDGE AND AGREE THAT YOUR PARTICIPATION IN THE PROGRAM HAS THE SAME EFFECT AS MANUALLY SIGNING THIS AGREEMENT WITH LOVE’S AND CREATES A VALID, BINDING CONTRACT BETWEEN YOU AND LOVE’S. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROCEED NO FURTHER, DO NOT OBTAIN SERVICES THROUGH THE ONLINE PROPERTIES, DO NOT ACCESS ANY OF THE ONLINE PROPERTIES, AND DO NOT DOWNLOAD THE MOBILE APP.

Store Discount Program Membership

The Program is a store discount program of Love’s provided as a privilege to you and other Love’s customers, not as an entitlement. Love’s, in its sole discretion, reserves the right to allow and discontinue membership into the Program at any time with or without notice. Program participants own no rights or ownership to the Program, including the points associated with the Program. Love’s is not reimbursed by third parties for the Program points or rewards, and there are no third party beneficiaries to the Program.

Email Validation

When registering a new or replacement My Love Rewards account, Love’s will send a validation email to the address provided by the customer. The customer must click the button on the validation email.

Privacy Policy & Online Terms of Use

Our Privacy Policy and Online Properties Terms of Use Agreement, as each may change from time to time, are incorporated herein by reference. The Privacy Policy and Online Properties Terms of Use Agreement apply to your participation and use of the Program, and are available HERE.

Email Validation

When registering a new or replacement Love's Rewards account, Love’s will send a validation email to the address provided by the customer. The customer must click the button on the validation email.

Love's may send verification codes via SMS text message to the phone number you provide to verify your identity and secure your account. You are responsible for responding to verification requests in a timely manner. Love's reserves the right to suspend your account access if you fail to complete phone verification when requested.

By providing your phone number, you consent to receive verification text messages from Love's at that number. Standard messaging and data rates may apply. You may opt out of receiving verification texts at any time, but opting out may result in limitations on your account access and Program participation.

You are responsible for keeping your phone number current and immediately notifying Love's of any changes to ensure you can receive important account communications and verification codes.

Data Collection and Privacy

Love’s collects personal information from you to operate the Program and provide you with rewards and services. By participating in the Program, you understand and consent to Love’s collection, use, and disclosure of your personal information as described in this section and in Love’s Privacy Policy.

Information We Collect. Love’s may collect the following categories of personal information from you: (a) contact information such as your name, email address, phone number, and mailing address; (b) transaction data including purchase history, fuel purchases, points earned and redeemed, credits, and payment information; (c) location data when you use the Love’s Connect mobile app or visit Love’s locations; (d) device identifiers and technical information from your mobile device or computer; and (e) other information you voluntarily provide when using the Program.

How We Use Your Information. Love’s uses your personal information for the following purposes: (a) to manage your Program account and track your rewards and status; (b) to process transactions and provide customer service; (c) to communicate with you about the Program, including bonus offers and Program updates; (d) to prevent fraud and ensure Program security; (e) to conduct marketing and promotional activities; and (f) to comply with legal obligations and enforce this Agreement.

Consent Required. Your participation in the Program requires that you provide certain personal information and consent to its collection and use as described herein. If you do not wish to provide this information or consent to its use, you may not participate in the Program.

Privacy Policy. For complete details about Love’s privacy practices, including how we share your information, please review our Privacy Policy, which is incorporated into this Agreement by reference and available at Love’s locations and online.

Your Privacy Rights. Depending on your state of residence, you may have certain rights regarding your personal information, including the right to access, correct, or delete your personal information, and the right to opt out of the sale or sharing of your personal information for targeted advertising. To exercise these rights or for privacy-related questions, please contact Love’s Customer Service at 1-800-OK-LOVES (1-800-655-6837).

Privacy Policy & Online Terms of Use

Modification

Love’s, in its sole discretion, reserves the right to modify any aspect of the Program or this Agreement at any time, including without limitation modifying, limiting, decreasing or canceling points or rewards. Material modifications to the Program or this Agreement will be effective thirty (30) days after posting notice of such modification on Love’s website or in the mobile app. Non-material modifications will be effective immediately upon posting. It is your responsibility to review the Program rules and Agreement periodically to be aware of any modifications. Your continued participation in the Program following the effective date of any modifications constitutes your acceptance of the revised terms. For your convenience and future reference, the date of the current version of this Agreement is noted below.

Account ID’s & Passwords

You are responsible for taking reasonable measures to protect your Account ID’s, including keeping your passwords confidential, not sharing your account access with others, and promptly notifying Love’s of any suspected unauthorized use of your account. Love’s is responsible for implementing and maintaining reasonable security measures to protect the Program and member information from unauthorized access. You agree to promptly notify Love’s Customer Service if you become aware of any unauthorized use of your Account ID’s or any other breach of security. Love’s will investigate reports of unauthorized access and may suspend your account access during such investigation to prevent further unauthorized activity. You agree to cooperate fully with any security investigations. In the event of a data breach affecting your personal information, Love’s will provide notice to you as required by applicable law. You will not be held liable for unauthorized transactions that occur after you have notified Love’s of unauthorized access, provided you cooperate with Love’s investigation and have not engaged in fraud or gross negligence in safeguarding your Account ID’s.

Disclaimer

LOVE’S MAKES NO WARRANTIES THAT PARTICIPATION OR USE OF THE PROGRAM OR SERVICES WILL BE UNINTERRUPTED, AVAILABLE AT ALL TIMES AND LOCATIONS, FREE FROM ERRORS, OR FREE FROM TECHNICAL ISSUES. THE PROGRAM IS PROVIDED BY LOVE’S ON AN “AS IS” BASIS, EXCEPT AS REQUIRED BY APPLICABLE LAW. TO THE EXTENT PERMITTED BY LAW, LOVE’S MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE PROGRAM OR THE CONTINUATION OF THE PROGRAM. TO THE EXTENT PERMITTED BY LAW, LOVE’S, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NOTWITHSTANDING THE FOREGOING, LOVE’S DOES NOT DISCLAIM LIABILITY FOR: (A) FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE BY LOVE’S OR ITS EMPLOYEES; (B) VIOLATIONS OF APPLICABLE CONSUMER PROTECTION LAWS; (C) PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY LOVE’S NEGLIGENCE; OR (D) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Waiver; Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, YOU HEREBY WAIVERELEASE LOVE’S (TOGETHER WITH ANY RELATED COMPANIES, PREDECESSORS, SUCCESSORS, AND THE AGENTS, OFFICERS, MEMBERS, MANAGERS, AND EMPLOYEES OF ANY OF THEM) FROM CLAIMS OR WHATSOEVER, DEBTS, OBLIGATIONS, OR OTHER OR RELATED TO PAST, THE THEREOF.

LOVE’S WILL NOT BE OBLIGATED OR LIABLE, FOR DAMAGES OF ANY KIND, WHETHER ACTUAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL, ARISING FROM YOUR PAST, PRESENT OR FUTURE PARTICIPATION OR USE OF THE PROGRAM OR SERVICES, THE UNAVAILABILITY OF THE PROGRAM, DAMAGE TO YOUR COMPUTER OR COMPUTER SYSTEM, OR ANY RESULTING LOSS OF POINTS, DATA OR BUSINESS INTERRUPTION RESULTING FROM SUCH PARTICIPATION OR USE, EVEN IF LOVE’S HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU ARE DISSATISFIED WITH ANY RESULTS OR PORTION OF THE PROGRAM OR WITH ANY OF TERMS OF THE AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE PARTICIPATION IN THE PROGRAM AND ANY SERVICES PROVIDED THROUGH THE PROGRAM.

THE NEGATION OF CLAIMS AND DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND LOVE’S. THE PROGRAM WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED THROUGH THE PROGRAM OR OTHERWISE SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT.

Indemnity

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD LOVE’S, ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, HARMLESS FROM AND AGAINST ANY THIRD-PARTY CLAIMS, ACTIONS, DEMANDS, COSTS, DAMAGES, LIABILITIES AND SETTLEMENTS, INCLUDING REASONABLE LEGAL AND ACCOUNTING FEES, THAT RESULT FROM: (A)YOUR MATERIAL BREACH OF THIS AGREEMENT; (B) YOUR FRAUDULENT OR ILLEGAL CONDUCT IN CONNECTION WITH THE PROGRAM; (C) YOUR VIOLATION OF APPLICABLE LAWS OR REGULATIONS THROUGH YOUR USE OF THE PROGRAM; OR (D) YOUR VIOLATION OF THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS OR OTHER PROPRIETARY RIGHTS. YOU WILL NOT BE REQUIRED TO INDEMNIFY LOVE’S FOR CLAIMS ARISING FROM: (I) LOVE’S OWN NEGLIGENCE, BREACH OF THIS AGREEMENT, OR VIOLATIONS OF LAW; (II) DEFECTS IN THE PROGRAM, MOBILE APP, OR LOVE’S SYSTEMS; OR (III) YOUR ORDINARY, NON-FRAUDULENT USE OF THE PROGRAM IN ACCORDANCE WITH THIS AGREEMENT. LOVE’S WILL PROVIDE YOU WITH PROMPT NOTICE OF ANY CLAIM FOR WHICH IT SEEKS INDEMNIFICATION AND WILL REASONABLY COOPERATE WITH YOUR DEFENSE.

Jurisdiction

You expressly agree that exclusive jurisdiction of any dispute with Love’s in any way relating to the Program resides in the federal or state courts located in Oklahoma County, State of Oklahoma. You further agree and expressly consent to the exercise of personal jurisdiction in such courts in connection with any such dispute including any claim involving Love’s or its affiliates, employees, contractors, officers, directors, telecommunication providers, and content providers (provided however, such claims are barred as set forth above, and consequently, should never be filed). This Agreement shall be governed and construed by the laws of the State of Oklahoma, without respect to its conflict of laws principles.

Miscellaneous

This Agreement constitutes the entire agreement between you and Love’s with regard to the Program, and supersedes all prior or contemporaneous agreements, representations, warranties or understandings with respect to the Program, the content, products, or services provided by or through the Program. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.

Effective February 1, 2026, Revised. This revised version supersedes the October 31, 2020 version of this Agreement.
