Love's Travel Stops – Wi‑Fi Terms of Service

Thank you for choosing to use the Wi‑Fi services provided by Love's Travel Stops & Country Stores, Inc. Our goal is to provide a convenient and reliable way for you to stay connected while on the road. To keep the service safe, fair, and easy to use, please review the terms below.

1. Accepting These Terms

By accessing or using our Wi‑Fi service (the “Service”), you agree to be bound by these Terms of Service (“Terms”). You represent that you are at least 18 years old or have parental consent to use the Service. If you do not agree, disconnect immediately.

2. What the service Includes

The Service provides public wireless internet access at participating Love’s locations. Speeds and performance vary and are not guaranteed. Love’s reserves the right to manage, monitor, filter, limit, or terminate access at any time, for any reason, without notice.

3. Responsible Use

You agree not to:

  • Access or share abusive, obscene, or inappropriate content.
  • Infringe on copyrights, trademarks, or other intellectual property.
  • Spread malware, viruses, or malicious software.
  • Interfere with or disrupt the network or other users.
  • Attempt unauthorized access to any system, network, or data.
  • Use the Service for commercial purposes, high-bandwidth activities (P2P, torrenting, mining), spam, or any harmful or unlawful purpose.
  • Circumvent security features, resell access, or use automated tools.
  • Engage in any activity that could expose Love’s to liability.

4. Your Responsibilities

You acknowledge and agree that:

  • You are responsible for any activity on the service that happens through your device.
  • You will protect your login information if any is provided.
  • You use the Service at your own risk and are responsible for all content you access or transmit.
  • You will indemnify, defend, and hold harmless Love’s Travel Stops & Country Stores, Inc. and its affiliates, officers, directors, employees, and agents (the “Love’s Parties”) from all claims, damages, and expenses (including attorneys’ fees) arising from your use of the Service, violation of these Terms, or violation of any law or third-party rights.

5. Security Notice

THE SERVICE IS NOT ENCRYPTED. LOVE’S CANNOT GUARANTEE DATA SECURITY AND MAY MONITOR NETWORK TRAFFIC. You use the Service at your own risk. We recommend:

  • Using a VPN whenever possible.
  • Ensuring your antivirus and device security settings are up to date.
  • Avoiding sensitive transactions while on public networks.

6. Service Changes or Availability

Love’s may modify, suspend, or discontinue the Service at any time without notice or liability. Service quality is not guaranteed. Love’s is not liable for interruptions caused by circumstances beyond its reasonable control.

7. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. LOVE’S DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVE’S PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED $100.

Love’s Parties are not liable for:

  • Loss of data or damage to your device or systems.
  • Service interruptions or performance issues.
  • Data loss, device damage, or service interruptions.
  • Third-party content, conduct, websites, or services.
  • Security breaches, viruses, or unauthorized access to your data.

8. Privacy

Your use of the Service is subject to the Love’s Privacy Policy, available at loves.com. Love’s may collect device identifiers, IP addresses, and usage data for security and operational purposes, and may disclose information to law enforcement as required by law or to protect Love’s rights.

9. Updates to These Terms

Love’s may modify these Terms at any time. Continued use constitutes acceptance. If you disagree, stop using the Service.

10. Copyright and DMCA Compliance

Love’s complies with the DMCA (17 U.S.C. § 512). Love’s terminates access for repeat infringers.

11. Third-Party Content and Links

Love’s does not control or endorse third-party content accessed through the Service. You assume all risk from third-party interactions. Love’s may block any content in its discretion.

12. Dispute Resolution

Any dispute shall be resolved by binding arbitration under AAA Consumer Rules, on an individual basis only. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR JURY TRIAL. Small claims court is permitted.

You may opt out of arbitration within 30 days of accepting these Terms by written notice to Love’s at the address in Section 15. Any claim arising from your use of the Service must be brought within one (1) year of the date the claim arose, or it is permanently barred.

13. Governing Law and Jurisdiction

These Terms are governed by Oklahoma law. You consent to exclusive jurisdiction in Oklahoma County, Oklahoma for any disputes not subject to arbitration.

14. General Provisions

If any provision is unenforceable, the remainder stays in effect. These Terms and the Privacy Policy are the entire agreement. Love’s may assign these Terms; you may not. There are no third-party beneficiaries. Sections 4, 7, 8, and 10-14 survive termination.
